I doubt it's a TPS. Have you had the CEL checked to see what it is? That might give a clue. It sounds to me like your throttle plate is held open somehow possibly the throttle cable is stuck or the throttle plate is stuck open. I'd remove the air intake tube and see if the throttle plate is seated properly, and work the throttle by hand to be sure it's not sticking open.
You can also remove the TPS to be sure that someone didn't fiddle with it. 2 screws hold it in, but if you remove the screws before the TPS, it should tilt slightly. This way the TPS lines up correctly with the throttle shaft. If someone removed it and put the TPS straight in, then it would not be working correctly. It doesn't fit flush like that either, you have to force it in with the screws. The TPS should fit flush without the screws in there, but you'll have to tilt it backwards for the screw holes to line up if you've installed it correctly. If you find that someone installed the TPS incorrectly, then you're most likely going to need a new one.
